Study leave

Study leave is, as the name implies, the period during which an employed person is released from work for the purpose of education or study. The purpose of the study leave is to offer the employed a flexible opportunity to study something new.

A person on study leave is free to choose what he or she studies during his or her leave, and the study does not necessarily have to be related to the employer or his or her field at all. However, studying must also be subject to public supervision when studying abroad.

Study leave can be granted for a maximum of two years in a five-year period if the employment relationship with the same employer has lasted for at least one year in one or more periods. If the employment relationship has lasted at least three months in one or more periods, study leave may be granted for a maximum of five days. Those who are on study leave can choose whether to use the study leave in one or more periods. Study leave can also be staggered so that the employee is at work part of the working day and part of the study leave, in which case the person has only partial study leave.

APPLYING FOR STUDY LEAVE

The employee must always apply for study leave from the employer. Study leave lasting more than five days must be applied for in writing from the employer at least 45 calendar days before the start of studies. Up to five days of study leave is applied for orally or in writing at least 15 calendar days before studies.

The employer must make a decision on study leave before the start of studies. If the study leave has been applied for for more than five working days, the decision must be given to the employee in writing at least 15 calendar days before the start of the studies. If study leave has been applied for for a maximum of five working days, the decision must be given to the employee orally or in writing no later than seven days before the start of studies.

FINANCING OF STUDY LEAVE

A person on study leave may be entitled to financial support during studies on study leave. The most common financial support during study leave is adult education support, which is intended to support adult self-education. The adult education allowance consists of a basic part and a salary-based earnings part.

Alternation free

Alternation leave is a leave period of 100-180 calendar days agreed between the employee and the employer. The employee can use the rotation leave as he or she wishes, for example for training, rehabilitation, childcare, hobbies or rest. During the leave, the employer undertakes to hire a person who is an unemployed jobseeker at the Employment and Economic Development Office to replace the person who is left on leave.

APPLICATION FOR ALTERNATION LEAVE

The use of rotation leave is tied to the employment relationship. Remaining on rotation requires a valid employment relationship, which must remain valid throughout the leave. An employee in a fixed-term employment relationship also has the right to remain on rotation leave, provided that the fixed-term employment relationship continues in accordance with the employment contract until he or she returns to the same job after the rotation leave.

FINANCING OF ALTERNATIVE LEAVE

During the rotation leave, you are entitled to a rotation allowance and you must apply within three months of the start of the rotation leave. The conditions for compensation are the same as when applying for rotation leave, but in addition to this, the employee must have been employed by the same employer for at least 13 consecutive months before applying for rotation compensation.

If the employee belongs to an unemployment fund, the rotation allowance must be applied for from the unemployment fund. Its amount is calculated on the basis of the earnings-related daily allowance.

The amount of the rotation allowance paid to a person on rotation leave is 70% of the unemployment allowance to which the employee would be entitled if he or she became unemployed. The compensation is calculated on the basis of earned income for at least 52 weeks prior to the rotation leave. In 2021, the rotation allowance calculated from the basic daily allowance is 23.65 e / day and it is taxable income. The rotation allowance is reduced by any salary and other income received during the leave.
