Malaysia's Vision for an AI-Driven Future: Pioneering the Enactment of AI Legislation

In a bid to lead the way in the age of artificial intelligence (AI), Malaysia is taking a proactive approach to regulate AI applications within its borders. The Science, Technology and Innovation Ministry is now exploring the possibility of enacting a groundbreaking AI law, with a strong emphasis on transparency, public awareness, and responsible AI use.

Science, Technology and Innovation Minister, Chang Lih Kang, revealed that the ministry is considering spearheading the drafting of a comprehensive Bill. To ensure its effectiveness and relevance, the process will involve extensive consultations with technology experts, legal professionals, stakeholders, and the general public.

The move comes in response to the increasing global trend of implementing stronger regulations around AI usage. With AI technologies becoming more widespread and prevalent in various industries, there is a pressing need for clear guidelines to govern their deployment.

One of the key elements of the proposed legislation is the labelling of material produced by AI applications. The Ministry aims to ensure transparency and informed consumption by mandating that content generated by generative AI should be distinctly labelled as "AI-generated" or "AI-assisted."

These standards may encompass guidelines on labelling AI-produced content and providing user-friendly explanations about the workings of AI systems.

The European Union has already taken steps in this direction with its "AI Act," a legal framework aimed at regulating AI use and addressing ethical questions and implementation challenges across various sectors, including education, finance, and healthcare.

AI companies, including industry giants like OpenAI, Alphabet, and Meta, have voluntarily committed to measures such as watermarking AI-generated content in the United States. Inspired by these international efforts, Malaysia's AI legislation would also address critical aspects such as data privacy and public awareness of AI utilization.

Mr. Chang emphasizes that the proposed law will not stifle AI technology's development but will instead strike a delicate balance between managing risks and fostering innovation. The Ministry remains committed to advancing research and development in AI and machine learning technologies while encouraging ethical guidelines and supporting innovations that counter misinformation and harmful content.

Recognizing the potential abuse of AI in elections, the need for clear regulations is paramount. A strong legal framework, along with ethical guidelines, will mandate transparency about the source of information and impose severe penalties for using AI tools to spread false information.

To empower the public in dealing with AI-generated content responsibly, the Ministry intends to invest in resources and public awareness campaigns on the fundamentals of AI and its use in content generation. Raising awareness about AI's capabilities and limitations will enable individuals to make better-informed choices, engage critically with media, and participate in discussions about AI rules and guidelines.
